Hon’ble the Supreme Court of India vide its Judgment dated 11th January, 2022, in ‘Smruti Tukaram Badade v. State of Maharashtra’ (Miscellaneous Application No 1852 of 2019 in Criminal Appeal No 1101 of 2019), has emphasized the need to create a safe and protective environment for vulnerable witnesses while recording their evidence. Vide the said judgment, the Supreme Court had constituted a Committee and appointed Justice (Retd.) Gita Mittal, Former Chief Justice of the High Court of Jammu & Kashmir as the Chairperson of the Committee with a mandate to devise and implement “an All India Vulnerable Witness Deposition Centre (VWDC) Training Programme as well as to engage with the High Courts for creation of infrastructure for VWDCs”.
